    In california, I believe digital media has to have an obvious distinction.

    Don't know how obvious it is. For one click of a kindle book you see:

    "By placing an order, you're purchasing a content license & agreeing to Kindle's Store Terms of Use."

    which "purchasing a content license" in bold.
